General Terms
1.1 Acceptance of Terms: By accessing and using the facilities and services provided by The Course @ Tree House (hereinafter referred to as "the Golf Course"), you agree to be bound by these Terms and Conditions.
1.2 Definitions:
"Golf Course" refers to the 9-hole golf course owned by THBC Tewksbury, LLC and operated by Tree House Brewing Company, Inc. (Management), located in Tewksbury, Massachusetts.
"Management" refers to the authorized operators and owners of the Golf Course.
"Player" refers to any individual playing or using the facilities of the Golf Course.
"Renter" refers to any individual renting golf clubs, golf carts, or any ancillary equipment from the Golf Course.
Golf Course Rules and Regulations
2.1 Code of Conduct: All Players and Renters must adhere to the Golf Course's code of conduct, which includes but is not limited to the following:
a. Respect for other Players and Staff.
b. Compliance with all posted rules and instructions.
c. Safe and responsible use of golf clubs and golf carts.
e. No littering or damage to the Golf Course's property.
f. No unauthorized removal or alteration of any property belonging to the Golf Course.
2.2 Dress Code: Course dress code is golf casual.
2.3 Safety: Players and Renters must prioritize their safety and the safety of others at all times. The Golf Course reserves the right to remove or restrict access to any individual who poses a safety risk either to themselves, others, Golf Course property or neighboring property, or fails to comply with safety guidelines.
2.4 Course Etiquette: Players must maintain proper golf etiquette, including maintaining an appropriate pace of play and repairing divots and ball marks on the course. Players must abide by the direction from Golf Course Rangers.
2.5 Golf Carts: The Golf Course may provide golf carts for rental purposes. Renters must:
a. Be at least 16 years old and possess a valid driver's license.
b. Operate the golf carts responsibly and in compliance with all applicable laws and regulations.
c. Return the golf carts in the same condition as received, aside from normal wear and tear.
2.6 Golf Club Rentals: The Golf Course may offer golf club rentals. Renters must:
a. Handle the rented clubs with care and return them in the same condition as received, aside from normal wear and tear.
b. Assume responsibility for any loss, damage, or theft of the rented clubs.
2.7 Alcohol Policy: Outside alcohol is strictly prohibited on the Golf Course premises. Only alcoholic beverages purchased from the Golf Course may be consumed on the premises.
Fees and Payments
3.1 Golf Course Fees: The Golf Course reserves the right to determine and modify the fees for accessing the facilities, including green fees, golf club rentals, and golf cart rentals. The current fee schedule can be obtained from the Golf Course's website or by contacting the Golf Course directly.
3.2 Payment Terms: All fees must be paid in full at the time of booking unless otherwise agreed upon by the Golf Course Management.
3.3 Cancellation Policy: Greens fees must be canceled at least 24 hours in advance to receive a refund.
Limitation of Liability
4.1 Assumption of Risk: Players and Renters acknowledge and accept the inherent risks associated with playing golf and using the Golf Course's facilities, including but not limited to the risk of injury, property damage, and loss. By using the Golf Course's facilities, Players and Renters voluntarily assume all risks associated with their participation.
4.2 Release of Liability: To the maximum extent permitted by law, Players and Renters hereby release and discharge the Golf Course and its Management from any liability for personal injury, property damage, or any other claims arising out of or related to the use of the Golf Course's facilities.
